What legal recourse do I have for a company not sending my husband his 1099? He worked as a general contractor for a few months with this company...Has been assured time and time again that it has been sent, yet every time we talk to the company we get a different version of who sent it and when...Gut feeling is that they never sent it at all! We can't file our taxes til we have this info...We are already kinda stressed because we usually file during the last week of Feb...it's already March 10th! We need to be able to claim all the deductions for the money my husband spent during the time he worked there. What can we do? I thought there was a law stating all W-2's and 1099's had to be postmarked by January 31st? Who do I talk to if the company fails to send us this very important information?

You don't really need the 1099. You should know how much he has been paid by your own records. Use that info to do your taxes. Since you have records for his expenses (the deductions you mention), you should be all set.

Assuming you have records of what he received and what his expenses were, go ahead and file, putting those income and expense amounts on his schedule C or C-EZ.

Well, call them up again and demand that they fax it over ASAP....!!! You need those documents to finish your 1040 so it is your right to get them. If that doesn't work have somebody call them pretending to be a CPA firm and that you need the documents....that should get their attention.
