I was visiting a friend of mine one day and I went to use the bathroom, leaving my daughter alone in the presence of this friend of mine. I have never had any worries before around him. When I returned to the room, my daughter looked scared or worried. She told me a couple of days later that he tried to french kiss her. I am wondering if he can be prosecuted for this. It has bothered her alot and she never wants to be near him again. And as a mother I will make sure that she never is. I was shocked, I told him how unappropriate his actions were, he appologized to her, but somehow that just doesn't seem to fix this. Any advice on what I can do?

I thank all of you so much for your answers. First of all , one response accused me of being the molester. How terrible for you to even think that. I love my children and would die before I would ever do something like that. I am a christian woman and an excellent parent. When I returned to the room, he was standing directly in front of my daughter with a hand of his on each side of her face. He hugged her and backed away when I came in, my daughter wiped her mouth with her sleeve and went YUK< OH YUK! I asked her what happened and she said that he tried to kiss her and he tried to enter her mouth with his tongue, and she held her teeth together so tight that he got into her mouth to her teeth only. When I chewed his butt out for doing that, he just laughed. I haven't prosecuted yet because I didn't know that this was having such a bad effect on her. She didn't talk about it till now and I see what it has done, so I sought advice..and here I am and I will follow through

Call your local police department...they may be able to get him on lewd or lascivious acts against a child under 14, depending on your state laws.

Yes! He can and should be prosecuted! A 56 year old man should know not to sexually molest a 12 year old girl and he is definately not sorry. I know this because he waited until you were out of the room to do this and said nothing to you when you came back. She is a child and you as her parent have to protect her from creeps like this. Think- if he tried this with your daughter- think of how many other girls he will try this with in the future...and maybe go even further. This is not a normal man- go to the authorities immediately before he does this again

Yes, your daughter is not of the Age of Consent. If you are in the United States, 18+ is the age of consent in most states (other states are 17+, and 16+, BUT NOT 12). The 56 year old man making an attempt to seduce your daughter is a form of child molestation.
I suggest you report this to your local law enforcement agencies, and DO NOT hesitate to file charges against this man.

Im not usualy a viloent person but i come from a horrible past. My grandfather melosted me when i was 5 till the age of ten. I am a mother now of a 3 year old lil girl and 2 year old lil boy! I would have snapped what bussines does a 56 year old man have kissing a twelve year old? You should have called the cops right then and there! He needed to be smacked and arrested that is not right!

Press charges now..... I would not allow this person around me or my family ever again... Also add a protection order from the police department which can be done if you press charges against someone... Make sure you discuss this with your daughter and let her know she did nothing wrong.. And that it is in no way her fault this happened... You should feel lucky that your daughter is not afraid to tell you this happened.... Good luck and call the police now...

GAH! Married or not, hell yeah, prosecute that *censored*{expletive deleted} sick dirty man!!! OMG! Yeah. PLEASE prosecute! That was disgusting and chances are, she isn't the first little girl or child he has violated. Do something before time is up. Take it to the media. Hopefully, anyone else this has happened to will gain the courage to come forward and be sure this man is punished for his actions.
I am very proud of your daughter for telling you. I'm sure you are, too. That took alotta guts. I'm sorry she went through this.
This would definately be a good time to let her take a self-defense course at your local YM or YWCA.

Call the police! Even if they can't arrest him without proofe, they will certainly scare him and keep an eye on him! The police need to know things like this and they need to go out and talk to him. He may try this with someone else or has already did something worse to someone else and no one knows about it. Report the perv and then have a long talk with your daughter and tell her his actions were not acceptable and she is not to feel bad of herself for what a disturbed man tried.

I'd go to the Police and find out as there are different laws everywhere but personally I think what you have done so far is good have you told your daugthers father or is not around because I'm sure that if it was my daugher that man would be leaving the area.

yeah he can be prosecuted or at least report the act so they have a pattern of behavior if he messes with someone else and as for telling him that his actions are inappropriate he already knew that he should have been punched in the head a couple of times rather hard

You could try to prosecute him but since you weren't there the cops might not take your daughter's word for it. Call the cops and file a police report however without eye witnesses there's not much they can do.

well your daughter is now safe but is mine? report this man right now today, go to the police, think about all the little girls out there, do you watch the TV, think about Jessica the girl berried alive, this man did this with you in the bathroom how gutsy what would he have done if you were not there, he is very very dangerous, please , for all the other parents please go to the police now, you would feel terrible if you heard he had hurt another child, when you have the power to stop it
