A friend of mine was recently thrown out of a really cool nightclub in new york and then beaten up outside by the bouncer. Is this legal? My friend says she didn't do anything and even if she's lying, why would the bouncer keep beating her up once she was outside the club?
Point is, is that legal? Also, are there other cases of this happening?

A bouncer can legally physically remove a person from a club, but they have no authority to hold or beat up a person outside a club. Charge the bouncer with false imprisonment, and battery.

If your friend was asked to leave and did not, that is considered trespassing. In every state in the county it is completely legal for the owner of a nightclub (or their designate, in this case, the bouncer) to remove you from the nightclub by force. This is true even in your own home, you can physically remove someone by force if they refuse to leave by verbal request alone.

However, once the person has been removed from the property, that right disappears. If what your friend said is true, she should have called the police regarding an assault. If what your friend said is not true and she was abusive or attempted to re-enter the club the use of force can continue.

Stuff like that happens all over the country. It happens when big tough guys take too many steroids and have to deal with drunk people. She should talk to a lawyer and definitely make a police report. It is not legal to beat someone. Even when you are defending yourself, you must stop at the point where the other person is no longer a threat. (For instance if someone pushes you, you don't have the right to stab them with a screw driver. You have the right to push them back and get out of the situation.) It sounds like assault, what the bouncer did.

Highly unlikely that a girl was assaulted by a bouncer outside a NYC club.

If she did and had witnesses she could be the club's new owner. If it's a cool club I'm sure there were people outside stand there in get in.

Was your friend threatening the bouncer? That is very odd that a girl would continue to get beat up unless you were not told the whole story. Which I suspect is closer to the truth.

The beating was illegal, unless you friend was the agressor, in which case the bouncer could use the MINIMUM for to remove her from the bar, NOT beat her as you claim.

I would think it's assault and the establishment should be held accountable for overzealous bouncers , it's often a big problem for some of these idiots trying to play mr. toughguy .
