That is a common myth that is not true. You bf/husband would have to meet the immigration guidelines and wait just like other people who immigrated. You will probably need a lawyer since he is illegally in this country. The INS can bar him from the US for 10 years since he entered illegally. You want to be careful about what you say to them.

If he has never been deported then maybe. I looked at the USCIS site and the I-485 Supplement A is still there (application for waiver of inadmissibilty - costs an extra $1000 IIRC). If he has been deported before they will arrest him the minute he shows his face at the office. Deportation orders can be served anytime and by law are now immediately re-enforceable at any time. Basically, if he was deportable in the past, he is still deportable.
As much as I hate the AILA. You may want to contact them to find out your best course of action. The Catholic church also has an organization which may be of use to you.

He HAS to go back to Mexico first. Sorry but he's an ILLEGAL alien criminal. Criminals don't get citizenship. Just because you are married doesn't give him the right to be a citizen either!
