The cat goes over their house every time he can. He escaped out when my neighbor took out the trash.

You're in my prayers. I can't imagine how the little kitty must feel after being shot, even if it wasn't a real gun. The noise can often scare them out of their wits, also!

Where do you live? What kind of a cat was it? I hate to tell you this, but if you live in the united states, you can't really get bupkiss (nothing) for injuries to a cat unless it is a purebred or otherwise valuable. The law in America does not recognize the emotional bond between animal and owner.
If your state or city has a animal cruelty law and it is a slow day for crime, you may get the city attorney to prosecute but you would have to have an airtight case. Did you see the little sociopath shoot the kitty or do you just think he did? If this is a first offense, he will get a slap on the wrist.
If the cats owners has vet expenses, the best thing might be to demand the shooter pay for them.
I don't agree with this, I just calls it like I sees it.

You likely won't be able to prove anything.
Keep the cat out of their yard.
It most places it is illegal to leave a cat roam, and animal cruelty laws specify "unnecessarily".... I shot a cat once in defense of an endangered species and no charges stuck.

I can't say beyond a doubt that they didn't have a reason.. if their cat was attacking their pet or some natural and protected fauna then they would be within their legal rights to shoot it just as they could shoot a dog.

If you want them to make a case of this...you really need to get some evidence and the law on your side. Tell your neighbors to get info/statements from the vet, and call the cops/animal control in your area to have them investigate animal cruelty.
Unfortunate for the kitty, but at least it wasn't anything worse and is still alive.

I would call the police on the people who did that. What they did is animal cruelty. It's good that you are telling your neighbors about this, but something more needs to be done. If you let them get away with shooting this cat, how many more is he/she going to shot. Good Luck.
