No; if you aren't interfering with public property and peace you don't need a permit.


Now if you were to have a garage sale with loud music on the street of your properties location; you would need a permit.

But if it's on your physical property and you're just selling stuff in a normal manner; without loud obstructions and without invading the peace of your neighbors; then you do not need a permit.

If you live in a rural area, chances are good that you will not. However, if you live in an incorporated area such as a village, town, or city; there is a good chance you will need to get a permit.

Many incorporated areas limit the number of yard sales that a homeowner can have over the period of a calendar year. Those that have regulations also usually regulate the number of consecutive days a particular yard sale may be held as well as the hours of operation. Permits are usually very inexpensive and can usually be obtained at your city hall.

These regulations are put in place to stop those people who seem to have a more or less permanent yard sale set up in their front yard. For all intents and purposes, they are operating an unlicensed business in a residential zone. This is irritating to neighbors who have to put up with the traffic and the piles of junk in the offenders front yard. These yard sales can have an effect on adjacent property values if left unchecked. Legitimate business owners also complain about them.

Legitimate business owners are usually quick to point out that a person who operates a "permanent" yard sale has an unfair advantage because they pay no taxes, have no business license, and have no business overhead.

My town charges $25.00 for a permit to hold a yard sale. It is good for two days that must be identified in advance. There is a provision for backup dates in case of inclement weather. Yard sales can only be held at the seller's residence. It is illegal to set up on an empty lot or a rented lot. Items for sale must be brought inside the house or garage at night. Hours of operation are from 8:00am to 6:00pm. Police often patrol neighborhoods on Saturdays and Sundays and stop and ask to see the permit. If the homeowner does not have a permit, they issue a citation that carries a stiff fine along with a cease and desist order.

More than likely NO. Though some citys do require a permit for a "garage Sale" but its a law that is never inforced... If you have a "Yard Sale" then no permit needed.

In most places you don't need a permit. Some towns and subdivisions will set aside a day or a weekend once or twice a year to hold sales in their areas. That draws many people to the area. If you are in a gated community you would need permission.

I don't think so not if you're in CA, when we do it we put out signs early in the morning and just lay out what ever. Cops drive by and they don't say nothing.
