the mother had the child in mexico, then came to USA and got married.At that time her child was under the age of 18.Since she was legally married in the USA she became a US citizen but there is no documents that her child is an US citizen but she does have a valid SS# . A couple of years ago her mother passed away and now she is over the age of 18 and her VISA is up for renewal and she is afraid that if she goes and renews her VISA she will be deported. She was raised here and all of her known family is here in the USA.She just wants to know what will happen to her????

A lot of you are missing the point. The child was born in Mexico. The mother was naturalized. The child was not. The child is now over 18 and not a citizen. She should be able to go to INS and get naturalized providing she has been here long enough and has satisfied the requirements for naturalization. She did not come here illegally. Tell her to call the INS and set up an interview. She should be OK.

If the parents are legal then the children are legal. If both parents die and there is no will stating where the children should be placed, they will go into the state foster system until a relative can be located and approved to raise them. If no relative is found, they stay in foster until adopted. However, if they have medical issues or other problems the chances of them being adopted are slim. Also, most adoption agencies try to place children in homes of their same ethnicity or one that is equipped to teach a child about his or her cultural background.

When the parents are legal the children are NOT necessarily legal, so I understand.

The point is that the child IS illegal. As a practical matter I think if family claimed them from the child's country, they would go there. If no one claimed them, it would likely depend on the children's age.

An illegal child, is still illegal. Still breaking the law by not appling to Immigration for a visa.

HUH? If the parents are LEGAL, how are the children ILLEGAL? It is usually the other way around.

If you mean ILLEGAL parents and legal children, they would have to be placed with relatives. If that means back where they came from, GREAT. That's where they should have been to begin with.

i heard a radio program about this.
sometimes it's sad
the parent doesn't have to be dead.
what if the parent is deported, in prison or just missing?

when the parents are legal the children are also officially legal so i guess the same thing happens to them as every other child whose parents die

I hope they are sent back to their country of origin to stay with relatives.
