Questions about army divorce..?

First of all, what is the process of getting a divorce, and about how long does it take. Second, what is the spouse entitled to in the divorce?? We have been married for 7 months. Three, how do I enforce child support??

I don't want to do counseling, I don't want to be with him....I don't feel anything towards him anymore.

He is in the Army. What exactly consititutes infedelity??

Ok, first of all, I'm not a whore. Second of all, He is not a good father, I practically have to throw our child at him for him to pay an attention to im. Third, He cheated on me with his best friends girlfriend...not sex, but he tried to sleep with her...they got as far as fondling each other.

Ha! our child isn't a beneficiary, I've seen his papers.

First of all as an ex. military wife and as a current military wife I can tell you that you are not entitled to anything after only 7 Months with a court order you may be able to get temporary support for both you and the servicemembers child and or children and but after the divorce you are not entitled to anything but child support for the child provided it is ordered anything else the judge may order it for instance if he orders your soon to be ex to pay you spousal support then you will get it which I doubt will happen after only 7 months so basically you are as you put it entitled to nothing unless it is court ordered but child support is a must but unless you have a seperation agreement or temporary court order for support if he doesn't pay it voluntarily DO not expect Jag to help you because they won't hopefully it won't come to that and he will be a man and support his child without being forced to do so.I am sorry you are going through a divorce hopefully this helps and I wish you well.

Only after 7 months?My GOD girl!What happened?You loved him enough to marry him and make a baby with him.Mow your going to trash your babies life by filing for divorce?Did he cheat on you?Beat you 3 times a day?Or did you just marry to get away from momma and to do your own thing?Depending on the state it can take anywhere from a month to a year.Think about someone other than yourself.You made vows to this man, and made a baby with him.This baby deserves a mother and a father and if he is a decent man, then give him the baby and go run wild, there will always be some scum bag willing to let you be his shack up whore.If he has mistreated you and you are in danger, by all means leave then.Put whats best for the baby before what YOU want, you OWE this kid that much it didnt ask to be born.

You will only get child support you were only married for 7 months and he will have to pay suport plus he will have to keep medical on his kids and he will also change his life insurance and perhaps he will put his kids as his benefactors but other then that you will recieve nothing and no entitlements i was married to a military man for 17 years and unless you are married to him for at least 10 years you are not entitled to any parts of his retirement if he chooses to retire.
When you get a divorce he will take you off as beneficiary wait and see, you will get nothing except child support so you are trippin if you think otherwise because he will meet someone else...

Now about divorce it " 4 U 2 KNOW MISS GRAMMAR" tht depends on every state, not all have the same law about it. MARRIED 7 months, and a child i guess you would only be able to get some money for the kid.
But you know what can you do instead of insulting others and treat then badly you can go to de library and the civil law about divorce.

The answer will depend on the following question...who is in the Army? You, him or both?

If it is just him...contact a divorce lawyer

If it is you or both of you....contact a JAG lawyer

Either way it will take some time for the divorce to be final and Usually things are split 50-50 in a divorce depending on where you live or are stationed.

If you are granted child support it will automatically be taken out of his check.

Try to work things out first , it seems like it only just started.
If that fails you must be separated for 1 year or be able to prove infidelity in the marriage. If you want child support you must file in your local court and speak to a lawyer , he will have to disclose his financial situation and the support will be based on that and garnished from his wages before he gets his pay.
Try talking with him before going to take legal action , it can get nasty and it is better if you stay on good terms if possible so you can help raise your child living apart if necessary.

If you are trying to get him in trouble with the Army via UCMJ. You are going to need proof of adultry. The military will not issue non-judicial punishment unless they are for sure they will win if the case goes to a court martial.
