First of all, you need to get a lawyer. Second, the girl needs to report all of the abuse to the police so it goes on record. In order to get custody of her you are going to have to prove her mother/step dad or real dad is unfit to care for her and she is in danger. She needs to step up and go to the police when she is raped.
Get a good lawyer who will help and look out for her in the states and odds are that you and/or your husband are going to have to come to the states and appear in court for custody. Either you or your spouse should plan to come to the US and start this process, as you are going to have to be here at some point anyway. At least if you are here you can meet with the lawyers, be with this girl and help her.

Is it her dad or the mother’s boyfriend... This sounds fishy... #1 A girl of 15 will probably NOT be allowed to move to Australia unless there is immediate family. #2 The girl will be a “ward of the court” if no other relations are around to take care of her if she is taken away from the parent. #3 This girl should seek help. She needs to go to school and get to the nurse… She then needs to tell the school nurse that she is being physically abused in a sexual nature by a person at home. This is very serious and her world will change. They will take her for questioning etc and start the whole ball rolling for her to be on a better path mentally and physically….
Have her get evidence. After an attack she could call 911 immediately and taken to a hospital and have a rape kit done. If she can not then have her save items of clothing that may contain semen stains and do not shower. There may be pubic hair of the offender or semen that can be used in trial…
This is VERY serious and should be handled by professionals like Law Enforcement.
NO CHILD SHOULD BE HARMED IN THIS WAY....
Another thing is that ... A lot of people lie on the internet. I'm not totaly sure that this person isn't making a story up. BUT, all you can do is advise what I just stated.

The ONLY way I think that a court in the USA would allow a child outside of the USA without a relation is if that child were adopted or Emancipated... You would have to probably show up in the USA for this to happen....

To be honest there is not much you can do. I am sorry to say this. The mother (though she may not care for her daughter) is the guardian of the girl. Unless she will give up her rights as a mother and will allow you to care for her there is not much you can do to bring her to Australia. However, there is something that you can do for her very easily...contact the police about the raping boyfriend....If you do that they will have an investigation into the matter and they will find that she has been raped and they might remove her from the home...if that is the case she will most likely go into a foster home, the mother will automatically lose her rights of being a mother and you might be able to adopt her...Please contact a lawyer or someone who understands adoption laws for Australia and the USA. She needs a lawyer and must file for emancipation from her parents. Depending on her state, the requirements for emancipation vary, generally, she'll have to prove that she can support herself. Some states she must remain enrolled in school.
Odds of her being allowed to leave the country I don't think are too good. If they declare the parents unfit, the state will take custody and not ship her off to Australia.
The only other way she could get emancipated is to get married...doesn't seem like the right thing to do though.

Sounds like kidnapping to me, you must go through the proper channels in the USA. Have the police been involved in this alleged rape activity of this teen,or is this just one teens story without knowing the whole story I would advise this teen to seek help from the police if being raped by her father, and boyfriend and for you to back off before you are also arrested for kidnapping.

For one thing her b/f needs to be reported to the authorities if her mother is aware of what is going on she also needs to be reported there is nothing you can do really the US makes it clear that there are channels you have to go through and if you are not a relative it is hard to do because children are placed in DSS custody untill a relative comes forward and then they have to be investigated and her father will most likely get custody if he is in the picture.

I think your best bet is to get in contact with the Australian embassy and give them a brief outline of your situation and find out different ways that you will be able to get her in to Australia as I am sure there is some way.Then when you find out the best path to take to getting her into Australia you can speak to the girl and her mother about it because you don't want to give this poor girl any false hope as as buy the sounds of it the girl has way to much to deal with as it stands.If there are no paths that you can take to get her into Australia you might have to get in contact with some of her family where she is living to see if any of them can step in and take care of her or you just might have to get social services involved if they are already.I hope that you find the right path to getting her to Australia.Take care.

There would honestly be alot of red tape unless the child goes to authorities with the accusations or if mom agrees to sending her to Australia and giving you guardianship. To do it yourself it would still have to be reported to the authorities and family services would have to get involved.

tell her to report or file complaints about her situation to the police/child care services . they should do an investigation then see if she can file for emancipation . if she does gets emancipated then she can freely do what she wants with your help of course .

invite her over as a visitor... and then cut her visa and identification up into little pieces... dude theres not alot anyone can do apart from report authorities.
