I am 43, Hindu-bhramin, staying in Ahmedabad-India, separated since Jan'04, staying with my two young kids and aged parents. How easy or difficult for me to get the divorce from my wife when she is not prepared?

You can file petition for Divorce under section 13 of The Hindu Marriage Act,1955 on the ground of continuous desertion for a period of at least 2 years or more. You have to prove her desertion with sufficient evidence for at least 2 years on this ground you can get decree of divorce.

One can't say until you start the ball rolling. Listen, just start the procedure, you don't have to commit to it, just start it! During this time you can stop if the $'s are going to be too much, if there is more headache than it's worth, or you may find an untapped cash cow here! She may be doing great living high class, while you care for the kids on a budget no one can stick too. The law helps those wronged! Just start the ball rolling, you'll be in charge and can stop it, or give it a swift kick to get it really moving.
