If your pa/pro is revoked and the state sentenced you to 3 in and 3 out, how is it that your able to appeal that decision while not incarcerated. You have an open case that hasn't been concluded but your revoked already. Is the state waiting for the conclusion of the open case or what? I always thought that if a person went to a revocation hearing and was revoked, that they would immediately be placed in custody. Am I wrong on that thought? Or could it be that the courts and state are giving you enough time to get your affairs in order before you go in?

Returning to prison is NOT automatic. You will be given a hearning.. a chance to plea your case.

During that hearing, it is best to apologize for your mistake BUT it is crucial that you HAVE A SOLUTION... explain where you went wrong and how you can prevent yourself from making the same mistake again.

Also, it helps bigtime, if your Parole Officer says a good word about you. If he or she doesn't like you, I would suggest talking to her and playing really nice...

Generally, once probation is revoked, you return to prison to finish the rest of your sentence. However, it is possible for a court to grant bail pending an appeal.

But if you were already sentenced, that that case would not be "open". Unless you are referring to charges for whatever was done to violate the parole.
