I'm always amazed at how many people are sure that the law guarantees break times here in the U.S.

(See this post for more info http://answers.yahoo.com/question/index;_ylt=AtJxhbBVWpCcd89xTlk715arxQt.?qid=20070309185153AAFJJa6) So why is it that so many people are sure they know this law? Especially when a person is NOT guaranteed break time. (It's based on whether your employment contract, ie, union employees or are covered by child labor laws).

Yes, you are right that certain states may consider different laws on this issue.

But no, I don't have a problem with people taking breaks, as long as they are entitled to them. Where I do have a problem would be if someone abuses it and it creates extra work for other people.

Each job may have different requirements. For instance, I work 10-hour days and get a short break for a meal period, but can use the bathroom whenever I need to.

I was able to get to the second linked question . Part of the reason for the confusion is that different states have different laws regarding break times. Additionally, some municipalities have their own regulations.

Your answer wasn't entirely accurate either, you outlined the federal statues regarding breaks, but you neglected individual state laws. Employers are bound by federal, state, and municipal statutes.

It depends on what you consider a break. You have to be legally allowed to use the restroom x amount of times, which could be considered a break. I would counter with, you should be allowed however many breaks you want as long as your getting your work done. Perhaps companies should be more worried about how much time they spend in 'meetings' which have been proven to reduce productivity significantly in this country. Just my two cents. When it comes to it... people are just uninformed otherwise. That's why.

What, do you think people don't deserve a break. Do you work 8 hours or even 5 hours without a break. Get over yourself!!!!
