It can be Japanese, but I would prefer a translated one. I do not think any English Hikaru No Go games were realeased, and that is why one that is self-translated will do fine.

I think the legality lies in a gray area if the software/show hasn't been officially released in the country it's being distributed in. HNG was shared without consequence for quite some time. It is only after it was contracted to be distributed here that the sharing threatened the originators commercial wellbeing and it was pulled from bittorrent distribution.

ROMs of commercial games are illegal if you don't own it, so you wont' find any help here on this.
