It seems the smokers spend most of their time outside seems like they get at least 20 breaks a day.

"Federal law does not require lunch or coffee breaks. However, when employers do offer short breaks (usually lasting about 5 to 20 minutes), federal law considers the breaks work-time that must be paid. Unauthorized extensions of authorized work breaks need not be counted as hours worked when the employer has expressly and unambiguously communicated to the employee that the authorized break may only last for a specific length of time, that any extension of the break is contrary to the employer's rules, and any extension of the break will be punished.

Bona fide meal periods (typically lasting at least 30 minutes), serve a different purpose than coffee or snack breaks and, thus, are not work time and are not compensable."

Basically you are talking about one half hour for lunch if at least six hours are worked. Usually two fifteen minute breaks and a half hour lunch in an eight hour day. Since the breaks are not mandatory and granted by your employer, if the need arises you can be required to work through your normal break time.

Nostranomous is the only one that is close to being correct. Federal law does NOT guarantee anyone a break time. However, most employers realize that it is only good business to give a person a break time.

The exceptions are:
When your company guarantees a break time (based on employee handbook)
When you're covered under child labor laws
When your employment contract stipulates break time.

Otherwise, an employer here in the U.S. is not legally obligated to give an employee any break or lunch periods.

I agree with the person who answered your question with the following response since this is how my breaks are scheduled at work...
The national average is this....for every four hours of work you get a 15 minutes break, if you work 6 hours you should get a half hour lunch, if you work a full 8 hour day, you should get 2 15 min breaks and a half hour lunch.

Employers that are not government employers do not HAVE to give breaks at all, but most employers allow 2 10-15 minute breaks on an 8 hour shift.

With most places if you work an 8 hour or more day you get (2) 10 minute breaks and a 30 minute lunch break.

I think it is 2 - 10 or 15 minutes break 1 in the morning and 1 in the afternoon. and a lunch break of minimum of 1/2 hour pending on your hours.

2 /15 min breaks and a one hour lunch some have one 20 min break. It all depends on the company

Two breaks and a lunch during an 8 hour day. Three breaks and a lunch on a 12 hour day.

You only need one!! That is for lunch! A half hour to an hour depending on the job and hours scheduled. Geez, who gets 2, 3, 4 or more breaks? When do they work?
