if a person were incaseriated and held beyound a week without going to court couldn't i file a motion to dismiss due to lack of due process under the 72 hour rule

You need to specify WHERE the person is/was incarcerated. There is no universal standard for how long a person can be held before appearing in court. Even if 72 hours is the rule in the place in question, it applies to the time by which the person must be formally charged with a crime. A court appearance may not be required.
