I do not know California law but you can get unemployment if you quit for what the agency considers a good reason, basically the unemployment office will schedule a hearing to decide if your reason for quitting meets their definition of qualified reasons.... A certain amount of penalty will probably apply - you may have to forfeit a months unemployment before you get your first installment...

I was on unemployment in Florida for almost a year. I quit my job because of harrassment. It would be to your benefit to apply for it, what else will they say besides yes??? NO.

If you are still at the job start taking notes, everytime something happens write it down. Take the notebook home with you at the end of the day and fill in details. Document EVERYTHING!!! Any witnesses to the harrassment, put down their names. If you have recently left the job go back into your memory banks, write down anything you remember, dates if not exact approximate, times, witnesses. If you can't remember the details think back to other things that might give you the date or time frame. I left my job, leaving a letter of resignation in the owners hand, it was in an envelope, he said thank you! :) He didn't know what was in the envelope, I walked out without any notes. I talked to a friend who suggested I apply for unemployment. I did all of the above, recreating in my mind to get details. When I applied they didn't talk to the witnesses they called the owners of the company, the woman dug herself in, I received unemployment. Hope this helps, good luck.

calif. unemployment dept. denied me when i quit because my boss belittled me in front of co-workers and customers. they said i should first have tried to solve the problem by going to the district manager and filing a complaint. so if you haven't quit yet, try doing that for a better chance at benefits.
