ok here my story goes...my husband who i have been with forever. has a child from a previous relationship, and has never seen his child,due to the mother...my husband and I have been to court for visitation and court said no visitation,but pay support, the mother waited 4 years to get DNA done and said her son had emotional problems and that was why the judge said we could not be in his life, but we have paid child support for the last 6 years and had to pay the for also the first 4 we did know he was my hubbys. Now we are sick of fighting the system so we want to sever my husbands rights? does anyone know if this can be done? just tired of all the bulls****.

Someone can always give up their rights.

But that doesn't mean he can choose to give up his obligations, such as child support. As long as the court orders him to pay, he's got to pay. Until the court changes that order, nothing he voluntarily does will relieve him of that obligation.

uh, good luck, what rights are you talking about? the only rights he has is visitation unless you sue for a change of custody, but no judge that makes him pay support without being able to see the kid is gonna give him custody, there must be more to this than you are telling, although the dhs and courts are a horrible nightmare. sounds like the mother is taking him for everything she can get.

yes you can give up your rights to custody of your children or child by going to your local court house and they will have a family law facilitator. Ask them for the help you need they will have the paperwork and they will file them in court for yoiu.
