No one has custody but my wife pays me child support(court-order).The children at the time live with me and went to school in the neiborhood.When my wife check got garnished in Feburary,She took the kids out of school where i live and place our son in school where she live.Now our daughter don't go to school because they don't have pre-k. All this happen this week,We had a routine for the kids the last 6 month.I have them during the school week and she have them doing the weekend. My lawyer call a emergency hearing in court which was today.The Master didn't wanna to make a decision because the kids wasn't in danger.He reschedule our hearing 10 day from now.The master told my lawyer 10 days won't hurt our daughter to miss from school.My wife is call for a child support hearing to get the child support reverse.The funny part my wife owes $1300.00 in back child support.

My lawyer feel she did this to get out of child support. Now that she took the kid out of school in my neiborhood and put them in her.There's a chance the judge still won't change it back to the same routine. Now I'm piss off and don't know what to do.

Also, next time... get it written into teh order who choses schools...

Not quite sure why the judge ruled the way he did here., because you have custody of the kids so she shouldnt have been able to change the kids around like this. Also since she owes back support, she should not be able to challenge you in court other than shes trying to get out of paying support. The judge must want to do some research into the matter so thus the reason for the 10 days. Since you have an attorney all you can do is be patient and let him handle this and pray for the best. Yeah, I really think she is doing this for financial reasons. She knows that if she takes the kids to her place and makes it their main residence (I don't know if she can legally do that), then she can try to ask the court for YOU to give her the child support. But, I think your case would be with the court that this is not good for the children, their main residence was with you and you did not give permission to wife to remove them from your household. Now you are concerned because the children have already been established in school and are doing well and are happy, and she just came in and took them out and this is not healthy for the children. You need your lawyer to fight for you in court, because she is using the children for money reasons and doesn't seem to care that she is disrupting their life. Also, tell your lawyer that you want to petition the court that legally the children reside with YOU. Then you will have a legal leg to stand on and she will be limited to what she can do.
