It was a blank memorex tape with the name on it in marker and they wont take it back cause they say they dont believe me how can I expose them?

Wow. My thought is to send a letter to the store manager and whatever corporate complaints address you can get, telling them when you bought it, where, for how much, and that you merely want to exchange (not return) the item because it was obviously tampered with either by a Best Buy employee or someone up the chain. Send photos of the jacket and the receipt if you still have it (I know I throw my BB receipts away right away...).
Although the previous answers are right, that it would appear that BB has violated copyright, I think a clear, but assertive consumer complaint would resolve this.

Of course, if you want to take legal action, there would be a number of routest that you could talk over with your lawyer. But is it worth it in this case?

If the company does not accept your statement, you can either take them to court or file a complaint against them for copyright violation.

In either case, you'd need to be able to prove your story.
