i have heard it is 12 in most states but i would really like to know for the state of wv or from anyone who has had to deal with this situation before thank you

it probably varies by state, but i think in CA once you're around 14 the court considers you mature enough to decide which parent you want to live with/visit.

The intellegence and stability of the child is also a factor as well as what the judge decides and the circumstances of the case. (IE. is it possible the child is being pressured by mom to say she doesn't want to see the father, or was there a history of spousal abuse that the child may have witnessed which is causing the distaste.)

Therefore it depends state to state, case to case, and judge to judge.

There is no hard and fast rule, sorry.

But yes, 12 is a good mid point.

At the latest, the age of majority (usually 18).

Many states also allow children to petition the court on their own behalf at younger ages, usually 16 or older but it varies by state. The court will then determine whether custody should be changed.

I thought it was at 16. You might call the court that you deal with and ask to speak to the Clerk of Court office, they should be able to answer your question over the phone. That way you will have the specifics for your state. Good Luck.

been there done that. to get correct answer in your state i would contact the local child support office. my own thoughts...if a child does not want to go and tells the "father" that should be enough. some just want to be jerks . good luck

While it does vary by state, usually, it depends on the assessed mental ability and maturity of the child.
