Depends. Is the employee in America? Do they have health insurance? Do they have a pension or 401(k)? Do they have garnishments?

There are many different issues that may, or may not, need addressed.

As for the tax guys, you don't report anything to the Federal government (again in the US) and no states that I know of require it. The termination more or less gets reported on the state unemployment return, but not until there are no wages for the entire quarter.

You need to give the employee COBRA notification, information about their 401K plan (if it applies). Some companies do an exit interview for voluntary terminations. Some also do a checklist form to make sure you get back all company issued equipment, keys, pass cards, parking permits, or any other items they may have.

The employer needs to file an ROE...Record of Employment.

I would think that they only need to file away your resignation letter in case you should turn around and sue. A lot of larger companies give exit interviews because they want to know why you're leaving-did something happen in the office to make you decide this-another way to cover themselves in case of a suit. They take away your privelidges to get into the bldg., take your laptop if you have one, car, phone, pager.

Local laws prevail on this one. Contact your labour department or an employment lawyer who specializes in the employee side of things.

Depends on the company and state laws, but generally they need to move your I-9 to another file, cancel your insurance and send you Cobra information, and random things inhouse, like get your paycheck to you. Things like that.

file a termination form, put in indivual folder, and remove from payroll.
