Legally, whenever it leaves a mark.
A spanking on a toddler still in diapers might be okay for those things they'd absolutely better not do - the things that are too dangerous to wait for them to learn not to do. Just remember that you're looking for sound to scare them, not pain. You could accomplish the same thing by smacking a yard stick on a counter and then yelling at them, though.
Beyond that, spanking doesn't do much good. You shouldn't be spanking them so hard that the pain is the motivator and beyond a certain age the shock effect wears off. (Hint: if you hear giggling as you leave the room, it's time to start finding better methods of dealing with problems).

Judging by how I've felt when I gotten physical in any way with my kids and by how my daughter asks me 10 years after the fact why I hit her (just a couple of swats on the butt), it's all abuse!
Kids need hugs and kisses, love and limits, time outs, restrictions, loss of priviledges, explanations, discussions, not hits, spanks, shoves and slaps.
When you hit, you've failed.

By hitting the child it shows her that hitting is alright. It is not. I'm sure you don't care to be hit and if you do, maybe you are the one who has a problem.

Well when you do it out of anger instead of punishment. For example if a child does something stupid, its fine to give it a spanking, as the bible says, spare the rod spoil the child.

When cause damage; whether it's physical, psychological, or emotional. When you hit a child you have to remember that you're only teaching them not to misbehave, you're not trying to hurt them. Don't do to your child what you wouldn't do to another person.
