My grandaughter is under investigation for allegelly causing harm to one of her children,though this has not been proven.The police want to inteview her two brothers at the police station without their parent being present.My grandsons have severe learning difficulties,are the police in their rights?one brother is 24 yrs old and the other brother is 15 years old.I would to very grateful for answers.thanks in advance.

It would not be correct nor legal for the police to interview the 15yr old boy without a parent or guardian present. As for the other lad who is 24 it is a different matter. If you could show that the lad has learning difficulties and would not properly understand the questioning you have every right to appoint a representative to be with him to make sure that everything was above board. I had a similar experience with a client who has autism learning difficulties and the police needed to interview him, so I explained to them about his problem and they were most accommodating in allowing another adult present. In most cases the police will give every assistance most of them are not ogres and are not out to intimidate.

Having recently had a few problems with my son and the law.
The 15 year old must have a responsible adult present at the time of the interview.
As a parents we all want to be involved as much as possible in looking after your kids.
But in a case such as yours i for one would give up that right and get all the expert help i could.
as MALIK L says in his answer this is not the place to be discussing these type of issues.PLEASE get a lawyer ASAP

the 15 year old will need an adult present by law
the 24 year old is dificult one as you say learning difficultys that need to be more clear on any event thay have rights one is to speak to a solicitor ensure that thay do speak and ask for the codes of police practice and reac section c
