My friend worked in a retail store and falsified some returns. (oops.) needless to say he got caught and when they questioned him he told them the complete truth and wrote a written statement in which he said that he stole and will be paying it back. The man that had him fill this out and sign it said he wasn't going to be charged as long as he paid it back. Then Bill asked if all the other employees were going to know...because a lot of them were his friends. The guy said no because it would break confidentiality so they couldn't say anything to the other associates. But Bill was just on facebook and got a message from one of his friends he worked with saying that his boss told them all that he had falsified returns. Which OBVIOUSLY broke that confidentiality. We live in Kansas and were just trying to figure out what he could do. Thanks!

Confidentiality as a matter of law only applies to certain professions, such as health care providers or attorneys.

If his boss caught him breaking the law, then his boss is free to tell people that fact. As long as its true. At best, your friend can argue that the boss violated his agreement to not tell other people, but that's not likely to get any remedy.

Most companies have confidentially policies, in which any HR info is kept from those that are not in a "need to know" aspect of the situation. If I were your friend, I would go to the boss's boss and tell them what happened. I think the supervisors would be interested to know about such actions by their management.

What he can do is be thankful the employer didn't have his butt arrested.
