They seem to think they're above the law, or that our laws don't apply to them. If we can smoke in there(ignoring state law), why not drink alc. after 2am? Are they allowed to police their 'reservation' any way they want? I tried to get 'banned from there (as a last resort measure for my addiction) and they said no. If, I raise hell or cause some trouble they said they would ban me, but not without going to jail.

If you make the choice to go to a sovereign nation you are also making the choice to be governed by that nations laws and rules. It is also your own responsibility to know those laws and rules. reservations are considered federal lands and their constitutions etc have oversight from federal entities such as the BIA and dept of interior

As for your last resort attempt to be banned for your gambling problem... are you aware of gamblers anonymous? There is help out there and you are not alone. Please find the strentgh to deal with your addiction in a more positive way then the course you have been on. Just like any other addiction you have to go where the real help is.

You seem to be missing the point of how reservations work.

State laws only apply within the state. Right? So, your state cannot pass laws that affect a neighboring state. Even if you're only 10 feet across the border into the new state, the other state's laws don't apply. The same applies to international borders, say being 10 feet into Canda. US laws don't apply in Canada, if if the US is really close.

Indian reservations are sovereign territory. They are not part of the state, any more than a neighboring state is. That's why the state laws do not apply.

And just like a neighboring state can enforce its own laws, regardless of what your home state does, the reservation can enforce its own laws, regardless of what the adjoing state does. That's the whole idea behind sovereign territory. Each state (or reservation) is entitled to set and enforce its own laws, without interference from other states (or reservations).

Indian reservations live by the reservation laws that have been created by their tribal councels. Due to the "nations" not being considered a part of the United States entirely, they choose what laws are covered on their lands and what isn't. I think it is "payment" for the white man coming into this country and slaughtering them and stealing their land from them.

Why in the hell is it a concern of yours? If you don't want to go there, then don't go there! The damn land is free, and no one is forcing you to go there. I think you are being rather stupid. . .

You are missing one BIG and GLARING thing. Indian reservations are soverign lands.....they have their own rules, police and courts. They make the rules that apply on their lands...

Think of each reservation as a separate country. You can't tell France or Germany what to do and you can't tell the Native Nations what to do.. They only have to adhere to Federal Law.

An indiain reservation is its own nation, just like going into Mexico. They have thier own govenrment, thier own laws and thier own police.
