Well, yes, you cannot have two lawyers representing you.

Normally an authorization and direction signed by you to your previous lawyer telling him to give the file to your new lawyer is sufficient and should be prepared by the lawyer you are now hiring.

Your new lawyer should fax it to the old lawyer together with a letter requesting the file.

If the new lawyer is trying to get you to do this leg work, don't hire him either.

If there are already court proceedings a Notice of Change of Counsel will likely have to be filed and served as well, but again your new lawyer should be doing this.

Your new lawyer is absolutely right about this. The reason is to prevent any law suits against you and your new lawyer. I suggest that the new lawyer gives you something in writing as far as cost for his services including the retainer fee.
Firing your old lawyer has to be in writing, I hope this new one is better than the old one due to reliable recommendation. Last suggestion, keep copies of everything and keep up a journal of everything that happens. A journal with dates, times and contacts will be very helpful.

You can't have two lawyers filing papers in your case, it will screw up the whole process. You have to pick one and that lawyer needs your file with everything any lawyer has done before them. Otherwise you could lose your caseand you can't appeal because your lawyer did not have all the facts. I have seen it happen. Having two attorneys does not help you, it can only hurt you.
