i have talked with another lawyer who will take the case, he says to fire him just wondering if that is the right decision, the one i have now just doesn't seem to be working with me.

Most lawyers dont like taking others lawyers cases. If you have one that will go for it, but you will still have to pay a percentage of your settlement to the current lawyer. Look over the contracts you signed and it will explain everything. The current lawyer is entitled to a percentage just for taking the case and doing the work that has been done so far. There is alot of paper work in lawsuits.
Also you are not the only client the lawyer has ,therefore you should understand he is most likely taking care of alot of other things before making your case a priority.

Lawyers cost too much to continue paying one you feel is not doing the job for you. Before I fired him or her - I would ask the lawyer you are considering hiring several important questions.
1. Will hiring you at this point delay the case?
2. How will you handle things differently from the other lawyer?
3. Will switching lawyers make us have to prepare the case from the beginning or are there documents etc. the other lawyer has prepared that you can and will be able to use?
If he or she answers these to your satisfaction, then go ahead and switch.

Are you asking the same question expecting a different answer?

Your new lawyer will be able to give you specific legal advice, including looking at any retainer agreement you might have signed with the old lawyer.

Pay the current lawyer for his services and then hire a new attorney. You might do a little more research and ask some questions this time.

If you have doubts
don't trust him to handle this (if it's important to you, it should be to your lawyer)
