he hasn't done his job and the car accident was in june 06 still have no car, can't work for the injuries, having to go to chiro. 6 days weekly and no car and no money i really need to settle and the lawyer doesn't contact me, he is never in and the few times he is he tells me to go to more doctors and i keep telling him i need to settle, i need a car and money to go to these doctors he says he doesn't know what to tell me except that i need to keep going to doctors and i have no money and no vehicle have pawned all i have and exhausted all financial resources.

It depends on what the retainer contract says.

Generally, if a lawyer can prove they spent X amount of time working on the case, they are entitled to recover for that (either hourly or on a percentage basis) once you recover.

As far as a settlement, just to play shark's advocate, it may not be up to him. If the insurance company is not willing to settle, then the only alternative is to press forward with a lawsuit. And that can take years.

Its not the lawyer, its how litigation works. It seems it almost takes forever. Its been 4 years and my brother still has even had a trial date or been offered a settlement . He suffered severe head injury, pulmonary clapse, broken femur,tibia, and had to have a blood tranfusion. Its up against a crooked insurance company that could care less because the person they represent is a crooked township supervisor that had the chief of police write a phony police report to cover up the crimes his son/ coowner in his company, committed. The strangest thing is that the cop that did the bogus report, and was told by a judge that he was scandelous, ludacris and didnt do any of his job, passed away about 9 days before his testimony for the deposition. And now the person that nearly killed my brother changed his story,under oath, But yet the fbi or the insurance company dont care about the crimes he has committed. Insurance companies are scandelous and dont want to pay out anything to victims of their clients negligents, although im sure his insurance rates went through the roof. But the insurance company must feel they are entitled to the money and not the victim that suffered permanent lifelong injuries. I would hold on because its gonna be a long ride.

If you feel that he isn't representing your interest then yes you can fire him. I would, however, talk to other lawyers about your case first to see if they can help do what you need to get done. If you fire the lawyer and accept the settlement that he's helped put together (that is to say if it looks like you're firing him just so you won't have to pay him) then he'll come after you and it's doubtful if you'll be able to find a lawyer to help defend your case.

Check the contract you signed with him. I'd bet at a minimum, you are responsible for any fees he has paid on your behalf (court costs, etc.)
