I was in a wreck back in april of 2003 and was originally cited for it. I got an attorney to fight it and I won. Well I was T-boned in the passenger side and from the hit I side swiped another car, he tried to file suit against me almost 2 years ago and the case was dismissed. Well last week I recieved papers that he is trying again but for more money this time. He recieved the smallest amount of impact and he is trying to get the most money. His wife is also trying to sue me now and she wasn't even in the car. I was wondering what I should be expecting to happen when I go in for this and to get advice from other people who have maybe experienced the same or something close to this. Thanks

My insurance company is already handling the problem and the attorney they provided me with last time was very good. I was just wondering how they can sue me, and what my odds are for this.

Call a lawyer. Depending on the dismissal, this claim may be barred by res judicata. There is also a statute of limitations problem.

The wife is probably suing for loss of consortium

Call a lawyer, dont make an appointment just call and ask them. I have done this before, they will most likely give you some good advice and explain the differnt options you have. Personally i think you have nothing to worry about as you have no control over where your vehicle was going to end up after the accident. The wife now sueing is just going to make them look more money hungry in court so it can be a plus on your side.

But ya, get out the yellow pages and start calling some lawyers that specialize in traffic and auto collisions. I hope this helps and everything works out. Good luck and Good health to you!

You "should" be ultimately successful in having this case thrown out of Court - but you need a good attorney to represent you to show the Court that you were not responsible for their injuries because the driver of the other car was the one that caused their injuries by actually colliding with your car.

And don't be foolish enough to be guided by others if they are not lawyers or attorneys.

Why is the wife suing you?
Did the accident have a significant impact on the injured persons libido? or was it impaired to begin with. You could ask your lawyer to pose this question to the jury, that way you could get his wife to stop harrassing you.
maybe these people are living in poverty and have selected this method to help them out. or maybe your actually to blame for willful neglect.

If it was dismissed 2 years ago, then make sure you still have your lawyer. Remember we live in a society where people get rich from getting burned on coffee at McDonald's.
