then proceeded to call a girlfriend or wife and talk about personal matters, (which involved lots of profanity) while I sat in my car and waited. 15 minutes later he came back with a ticket. Can I use this irrational behavior as grounds for dismissal? Any Links for me would be great!

The supreme court does not provide for "reasonable" amount of time for a traffic stop. There are to many variables that can occur. If I'm writing you a ticket, which is what happened, his conversation has no bearing on your circumstances. If I were asked, I would simply state I was waiting for the drivers return to determine if your license was valid. This can take a few minutes. I don't see that you are questioning the fact that you were stopped legitimately. Why don't you own up to the offense and pay the ticket?

Absolutely! The court is always impressed with how the alleged phone call of a police officer totally erases whatever traffic infraction you committed.
I think you should DEMAND that the judge drop the matter, or you will report him or her also. This always gets their attention and you will get to spend some quality time with them.

No, you can't. IT was unprofessional of him, but it does not affect the validity of your ticket. I would suggest you promptly pay the fine, and then in a separate correspondence, send a polite letter to the chief of his department, explaining what happened and asking that his behavior be investigated. Period.

Oh yeah, That's what you should do. Go tell it to the judge, I'm sure he will be happy that you are taking up the courts time with nonsense.

no, he made you wait while he called someone on his phone, not being considerate, not being polite is not right but not grounds for dismisal of any ticket

You can report him to his supervisors for his actions.

no. and he can take care of a personal matter even though it was unprofessional. but I would not try to use it in court

no....one is personal and one is criminal...did you do what the ticket says you did?...you can file a complaint aginst him with his chief but it has no bearing on the citation
