when you are owed back pay do you automatic recieve it when the payer file taxes?

DEPENDS upon the amount owed, and the IF the "payer" owes or gets a refund or not. lets say your owed $2,000. and his refund is $500, then you get it all. if his refund is $4000, then you get what is owed you. if he owes, you get nothing (this time).

it will take a couple of months to get to you... after they take it. they intercept it (state and federal), then do lots (and LOTS) of paperwork, then reissue it to you.

also depends if your caseworker has submitted your amount for 'tax refund intercept' or not.

call and ask if they did. also ask if the amount of the arrears are reported on thier credit report yet. also ask how you can apply to get interest on the arrears amount.

if your caseworker (or dept)isnt on the ball, pull rank on 'em. write to your states Attorney General, Governor and your states Regional FEDERAL Child Support Office.

No.... unless maybe that person is due a refund. They will take it out of the persons paycheck if there is a court order to do so. I would go that route. In most states the parent will go to jail and lose their license if they do not pay... just look at Bobby Brown. I think people who don't pay child support are some of the worst people in our society. For whatever reason, they feel that they are giving the money to the person who they had a child with and that person is going to live it up.... but anyone with half a brain would understand how much it cost to raise a child.... and it just gets more expensive as they get older. Very sad. The law is on the persons side with the child, as it should be. The non paying parent will have to pay sometime it is guaranteed. They can get their money siezed from bank accounts, liens on their home, a judge can order them to sell an high valued item or vehichle... it is endless.

It depends. Are you recieving any kind of "help" from social services? If so, it will go to them. If you know he has filed, keep checking your balance. If nothing significant shows up, call your caseworker and ask what's going on.

I think your lawyer has to file papers to do so, but I'm not sure. I know that you can take them back to court and ask that they garnish his wages. My sister did that because she knew if she didn't her ex-husband would not pay what he was supposed to.

Yes that's what happen to my guy.They just took what was owed.

laws are different in every state, but you should get their tax return check.
