It is after sunset. Driver X is heading southbound and then moves into the center lane to make a left hand turn (to head East) into a neighborhood street. Driver X proceeds with their turn. Driver Y is heading northbound and collides with Driver X as Driver X is making their left hand turn. Driver Y was traveling with the headlights off.

Which driver should be found at fault (or should both share responsibility)?

something similar happened to a friend's son and unfortunately the person making the left hand turn was found to be at fault. The person making the left turn must always wait until all is clear, even if the other person is speeding. Sorry, sounds like you are the victim of unfortunate circumstances.

Lots of variables. Width of the road, lane width, center lane a turn lane only? Traffic heavy, moderate, light? How much light was left after the sunset (there is still a little light left), any street lamps? Then comes the speed of driver Y upon the point of impact. Driver Y would probably be at fault but driver X would also be charged with failure to yield if there is a probability that traffic was moderate to the point where driver X didn't want to wait. Anyway, that's why there's courts.

In Canada, who's at fault will usually be determined by where the impact initially took place- face to face is 50/50 (both parties). Anything else is usually the driver's fault who's car or vehicle face impacts into any other area of the other vehicle. Even if their head lights are off, the argument would be, "were your headlights on?" However, have they been issued a ticket by the police and failed to fix the problem? This may help change the situation because they know that their headlights are off and they are not suppose to be driving legally until the lights are fixed. The law can be difficult, depending on the circumstances involved! You or the other driver may have medical conditions too- lots of fun!!

If it was during the day it would be driver Xs fault for making a left turn since driver Y would have the right of way. However if it is dark outside and driver Y had no headlights on and driver X makes the turn and there is a crash. The accident should be the fault of Driver Y...however go to a lawyer see what they say

Driver Y with the headlights off. Had the headlights been on, Driver X would have been able to see Driver Y coming and would therefore not have made the turn. It is very dangerous to leave your headlights off and I think Driver Y should take the blame because that's a reckless thing to do, simple as that.

hmmmm, tough choice, were there street lights? if there were then it was drivers X fault. if there werent then i guess driver X b/c driver Y has the right of way even though the headlights are turned off. i think driver Y should have to pay a fine for driving with no headlights.

Driver Y because he was driving out of the sun with out his lights on so that driver X could not see him comming before he started his turn.

I'd say driver Y is at fault, because he was breaking a law that subsequently caused the accident.

Sorry, not enough facts - what about traffic signals? How long after sunset? Were the streetlights on? Where on x did y hit? Was anyone drinking? Using a cell phone?
