for a while (up to 48 hrs) but generally he/she is entitled to bail because the constitution implies the concept of bail by stating excessive bail shall not be applied

technically, judges need not set bail because the constitution only prohibits EXCESSIVE bail not no bail at all so in severe cases they will stay locked up

it depends on community ties, family, work, criminal history, and chances of fleeing the state/country as to how high bail is set

Anyone charged with a crime is entitled to a hearing regarding bail. There are a couple of reasons to deny bail or to set very high bail. One, is if the offender is a flight risk, and the second is to protect the public. It is going to depend upon the severity of the crime and the amount of evidence available.
Unfortunately rapist and people who commit sexual assault are sometimes granted bail.

Not usually. Judges very seldom deny bail. Until a jury says "guilty" there is no way to keep him in jail. Often times people aren't even required to post bail. In most cases police aren't even required to arrest a person. They can issue a summons to appear in court. It's not until they either fail to appear in court or are found guilty after a trial that they ever wind up in custody. Our jails are stuffed full of harmless pot smokers, there's no room for sex offenders that haven't been found guilty yet.
