I did M.C.A in my back country,I m on F1 status right now,I m doing my 2nd semester,
i want to change my status from f1 to h1 with the help of consultant,Thoes consultants are saying me that its possible,
But i m like........... than why everybody's not doing it..
My Qestions are :
1)Is it possible to convert the status from F1 to H1 so early?,
2)After getting H1 can i study along with work.
3)My 3rd semester's time period is from August to december
Suppose if i will get that h1 than it will be valid after October 1st ,So my question is,what will happen to my F1 i know it will get cancel but than in what status they will allow to complete half of my 3rd semester...
they just change my status from f1 to h1 and allow me to finished my half semester or they will drop me from the class and i have to register again that class in next semester...

Talk to your school advisor. it doesn't sound good to me. Also check the reputation of your consultant. Do not believe everything they say. Good luck.

Probably not. The minimum education requirement for an H1 is a bachelor's degree. Also there are very strict rules about students working, especially in their first year.

I can't personally speak to your consultant but I would advise you to use extreme caution when someone tells you "sure, why not" to a not-so-common issue. There was an immigration attorney in Sacramento that I was aquainted with that would take $1500 from people to do the petitions for folk's relatives when a 10 minute interview should have given him enough information to realize the relative was SOL (sold out of luck). He would call them back a week later and return HALF the money and tell them that after further review of their case that he could not help them. If they objected to only getting half their money back he would point to $2 worth of paper and ink that his printer spit out and tell them the rest of the money covered his research fees and costs for filling out the applications that further research had deemed worthless. Probably took his secretary 15 minutes to input the data to have the computer auto-fill all the forms.

8 CFR 214.2(f) covers students, 8 CFR 214.2(h) covers H1s. Check it out on the USCIS website under 'Laws and Regulations'.

Where are you from (back country)? What is MCA? What kind of job are you looking into?

If you already have a bachelor's degree you will need to have it evaluated to see if it meets U.S. equivalency standards. If it does, and you intend to continue your education while you work, you need to find out from USCIS if you can go to school while you are an H1 (your foreign student advisor may know the answer to that also.)

I don't think you can do that. You can study with your H1, but usually people get H1 during OPT, or they get it when they are outside of the country. If you get H1, your F1 will be canceled, but you can study. The best thing to do is to consult this question with the international students department of your university.

Unless you have an executive order to convert your immigration status to H1. You need to complete your study first, then get an internship to present your skills for H1 consideration from your employer.

In the meantime, run far from whoever "your consultant", unless you want to loose your money and changing your status from F1 to "illegal".
