YES-FILE! If you fail to file on time, you will be hit with penalties. Now if you have a refund on the new return, chances are it will be applied to your debt. Whatever is left due, you can set up payments to resolve. I would file ASAP to get the credit applied now.

File the return. If you owe money on it, pay that first. NY will probably encourage you to pay the previous year first, but that is more expensive for you. You can stop all penalties on the 2006 return that way.

If you are due a refund from 2006, NY will apply it to what you owe for 2005.

If you dont file on time, they will charge you more penalties and fees. Definitely file on time and continue paying on the other than you owe.

you can file.

what you owe, they'll take out of your return, or just tack it on to the bill (if you have no return coming to you).
