My daughter is now almost 2 months old, and she was conceived from rape by my ex boyfriend. I never reported it, however I do have emails where he admits to doing so. He moved states away, but when I had my daughter he moved back. I have allowed him to see her, but he is getting very creepy. He calls several times a day, randomly shows up at my house, is outside my house and doesn't even tell me... and he tells people we are together even though we aren't. He is completely obsessed. When I was still pregnant he threatened to kill me and kidnap my child, I have a text message to prove that. He was also physically abusive in our relationship, and I have emails to prove that as well. He also has been seeing a counselor whom he has told all of those things to.
He is not on her birth certificate And I don't want him around her anymore... Is it possible to get full custody of her, and to get a restraining order?

Since your were not married at the time of her birth you already have sole custody. If his name isn't on the birth certificate until a DNA test is done to prove paternity, you do not have to allow him to see the child. Once paternity has been established then you will have a fight on your hands for visitation, but keep every single documented proof of things he has done or said and take them all to court with you

Absolutely and you need to do something ASAP! He is stalking you right now and you should not have any problem getting a restraining order against him, you need to file a complaint with the police right away. I would consult an attorney about the custody issue, though he is not listed on the birth certificate as the father he could hire an attorney to prove that he is and get visitation rights. I would not worry about that though with all of the evidence you have against him, right now that is the least of your worries. Call the police and file a complaint now then deal with the rest of this, you know his behaviour so don't wait!

I would say get a lawyer asap! Take all ur documentation to the lawyer....they will make copies of it and keep on file. U should get full custody of that child....only thing is ....u would have to probably accept that he won't be permitted to pay child support since u want full custody. BUT that also depends on what state u live in and what their laws are for fathers. Your case however is pretty serious and sounds like u need a lawyer immediately to get things started before something happens to ur child or yourself. I would change phone numbers and switch locks also on ur house. Always trust ur gut instinct. Us women are the best at sensing when things are not right and please trust yourself in this situation. I answered this question because i sincerely am worried about ur situation. Please get a lawyer and get paperwork started before he gets the idea to seek out a lawyer himself. The way he is acting it sounds as if he is stalking YOU, not to see his child. I suggest you seek legal counsel or at least go to the police, he has no right to stalk you whether he has visitation with the child or not. You need a custody/vistation order that will spell out exactly what he is entitled to and it doesn't include stalking your or making threats, once you have that order if he continues to stalk you then you just call the police and they will take care of it.

Take him to court and tell them all of this and bring in your what you have to prove it. And get a restrainning order for youself and your child.

Also if you can move. Dont tell anyone he knows where to and tell your friends and family to keep it to themselves.

Take him to court. Take all the evidence you have to prove that he done that to you. I would get a restraining order against him. That man is really crazy!!! Get you a pit bull(dog) make it really mean so if you was to come in your yard or house that dog will tear him up.
