Yes. You should contact local authorities anyway as well as filing for identity theft victim protection and have the cops give you a copy of the report and send it to the credit bureaus in order to freeze your report so that there can be no further damage done.

SarahK is correct as far as she goes. After you file a police report it will be up to your local District Attorney's office weather on not they will actually file charges. My wife went through this a couple of years ago and the credit card company cleared her credit. But sine the person that stole her identity was her Son, the D.A. refused to prosecute even though my wife said she wanted to.

You can file a police report about the stolen credit card.
If the police investigate and actually find the suspect, then it is up to a prosecutor to file charges. It is a prosecutors decision, not yours. A prosecutor will determine if there are enough elements to meet the requirements of a crime. If they feel it's not a strong case, they can choose not to prosecute and you can't do anything about it.

You should file a police report with your local police. HOWEVER, only in extremely rare & severe cases will they actually prosecute these creeps. If I were you, I would plan on making a regular, loud nuisance of myself at the DA's office until the person is prosecuted fully. The reason these jerks get away with this is that law enforcement does not take it seriously, imo.
