"The funerals will be held today for a Johnston County (North Carolina) father and son who were killed in a traffic accident this weekend. Dwayne and Jerry Braswell, Jr. were killed Sunday night in a hit and run crash. Police say that that Lucian Tollez drove the car that hit the Braswells. Tollez faces multiple charges including hit and run and manslaughter. Tollez had previously been found guilty and jailed for driving while under the influence and driving without a license. Tollez is in the United States illegally."

The local Raleigh, NC news has been reporting this story all morning. Why is Tollez still in the US after having been arrested and spending jail time on other occasions? Why was he not deported the first time he was arrested?

LuNiz - don't get me wrong, I deplor drunk driving by anyone. However, in this case (and you are hearing of it more and more often in this state) if Tollez had been deported (or not here in the first place) that man and his 9 year old son would not be dead.

Finally one I can comment on:

Firstly, Lunis (and BarB), why are you twisting his words everything? Mind the Gap never insinuated that “driving drunk” was ok if you a citizen or not. He focused on the fact that an illegal immigrant with a criminal history was still in the country. Secondly, people die everyday every where. That’s will never change, we need to get over death and how it happens, what’s important is that there are people BREAKING THE LAW and no matter what you think we, as citizens, are allowed and even obligated to abide by the law. So why are so many people pointing breaking the law and not getting justly punished?

Finally, the question is highly disturbing and only demonstrates how corrupt our government has been and I believe if you do nothing or are not going to do anything you have no right to say anything! This is a silent war and somehow the immigrants are winning. Don’t you people know, ‘Whoever wins the war makes the rules’.

I for one will not allow it, and if you call me racist then fine; but let tell you one thing, this is my country no matter how ****** up it is. I fight for it to keep my rights intact. I am not going to divulge into how the Illegal population affects us, there are a myriad of articles in here that you can read--- but the most powerful example of their effectiveness is that we are actively talking about it. This is a mark in history, and it will be interesting to see how it plays out.

On the case of Illegal Immigrants, not all of them are stupid/corrupt/in gangs/deals drugs/etc.. etc.. and that goes for every race. Just because I am black does not mean I am going to play the “race game” nor do I do drugs, sleep around and listen to rap. And as you can tell I am literate. So that should clear up any further comments impending my being called a racist.

I have a lot of Hispanic friends, in fact Asian and Hispanic people are in my core group--- but they assimilated to the “American Way”. They have their culture but the live here now and that is the problem we have now—Illegal Immigrants who come to our country and don’t assimilate. It’s disrespectful to us as Citizens and something should be done!

Answer: Yes! Disturbing and yet all to common in these days of America under siege from the state sponsored invasion from a "friendly" neighboring nation. That scenario is so common to Every American Locality that the incident you refer to was only given coverage locally.
In a population of over 300 million, an invading subset at a high estimate 30 million, 10%, populates State and Federal prisons at a 30 plus % rate!!!
Something is horribly wrong with that picture!
Only enough irate citizens will force politicians to revive Eisenhower's solution and reverse the current trend and re-establish American sovereignty.

Why do many on here who oppose illegal immigration now use that excuse? I've seen it more and more each day on here. "if they had been deported so and so would be alive". That's like saying "if bush never had been president many families wouldn't have lost a loved one in Iraq". the truth of the matter is nobody can foretell or foresee the future. Yes i also am oppose to drunk drivers and still don't understand why many of them don't seem to get it through their heads that drinking and driving almost always ends up in tragedy. Yet back to your question, you cannot foresee the future. You don't know for a fact that these people wouldn't have been hit either way by a U.S citizen who was driving drunk. As for the police arresting the guy,they had no warrant on him so therefore they couldn't arrest him. His only offense was driving drunk and without a license,and if he got arrested for it then every person who commits the same crime has to be arrested for it. Now if they had proven he had a lot of unpaid tickets and a warrant out on him then yes they could have arrested him.

It is very disturbing but seems to be a common occurrence anymore.
What I also find disturbing is the people who almost defend these actions by saying these things also happen when an American citizen is at fault.Yes they do,but why can't people understand that if this person had not been in our country ILLEGALLY this family would still be alive?
A friend of my step daughter was recently raped and stabbed to death by an illegal who lived next door to her.He had also been deported before but thought it was his right to come back.Had he not been here,she would still be alive and continuing her studies to be a nurse.
Why can't people understand this?

Unfortunately this is not an isolated incident. You hear every day about illegals killing American citizens. America needs to wake up and get serious on the illegal issue. We need to deport them all and shut down the border. The law is the law, and they are all breaking the law.

I find any news of any needless death to be disturbing, no matter who the perpetrator is. Drunken driving is a deplorable action for anyone. I am anti illegal alien ,but there are millions of people of all descriptions/legal status, that are drunk drivers.There are many things that I find that are only caused by illegal aliens other than drunk driving. (which far too many legal Americans do too)
Your point is taken and I understand and share your concerns but we can post horrific stories like this all day about illegal and legal people. Any ones death is a tragedy ,I'm not making light of this mans crime. But the negative impact of illegal aliens on America as a whole is more my concern.

This is an invasion ... these people are a clear and present danger.

By the way, to the "every race does this" crowd: This is the immigration forum, not the daily news forum. Besides no one excuses legal drunk drivers. But why import more? I don't know if it's true or not but I've heard this is a norm for this culture to drink and drive.

Um, the thing about being a deported illegal is that you have nothing to lose by entering the country illegally again. This is probably what happened after he served time and was deported - he is not still here, he is back.

For the benefit of others who don't seem to get the point. If the laws had been enforced. This killer would not be here, and these two Americans would be alive.

I don't know this family, but in their shoes I would be bringing a 900 million dollar suit against Mexico, the INS, the company this man worked for, the insurance company who covered his car, the mortgage agency or landlord who provided his housing, the utility company who supplied his utilities and the bank where he deposited his money. All of these entities are guilty of contributory negligence.

More PREVENTABLE American deaths!!! If this ILLEGAL had been DEPORTED, these people would STILL be alive!!!!

I think the FAMILYS of victims killed by ILLEGALS, need to start lawsuits against our government and our president, for NOT making sure our immigration laws are being ENFORCED!

to "nexus k" the REASON you are seeing these kind of articles more and more, is because EVERY DAY there is such an article in the newspaper!!! ILLEGALS are KILLING innocent Americans, DAILY!!!!
