If you're visa has already expired, you won't be able to do a Change of Status (COS) while in the US. You'll have to leave, apply for the H-4 (with your marriage certificate) and then re-enter. Keep in mind that since you've fallen out of status before, it may be harder to get another US visa.

If you wish to stay longer than the date indicated in the Form I-94, you must apply to extend your B-1 status.
Note: You must submit the application for an extension of stay # BEFORE " your current authorized stay expires. #
for a H 4 visa ?:
10. Where should I submit my H4 visa application?
If you are:

• # In a lawful status in the U.S. #, .....................................
submit the H4 visa application to a USCIS field office in the U.S.
so the answer to your question is NO , one must never let one's visa expire, it would them UNLAWFUL ? they should apply # # before # for another visa ..
