Well to some extent yes, and to some extent no. They were both at fault for the DUI and A shouldn't have crashed the car but may have saved B's life if he was actually going to kill himself. I think they should both be at fault and A should fess up to what she did, as it's wrong to endanger both of their lives and also the lives of other people on the road. Basically they should share the blame

He was drinking *more* than her and still got behind the wheel? All the other stuff doesn't matter.....regardless of whether she pulled the steering wheel or not, the burden of responsibility is on him. Perhaps if he was sober and she freaked out, he would have been more able to handle the vehicle. That's the whole point of not driving 'while impaired'.... they should have split the cost of a cab and faught in the backseat.

Would he have had the accident if she hadn't yanked on the wheel. In this case, I believe he should be charged with DUI but she should be charges with causing an accident. I don't blame him for being upset. He could possibly have gotten home without an accident if she hadn't yanked the wheel, even though he was driving drunk.
