I have a friend who was in a relationship for 5 years, which now is over.
The problem is that they both had vehicles and at one point refinanced them and put them in both names (his and hers) thinking that they were going to be together forever. Then they were both registered and insured in my friends name.(cheaper insurance) When they split they agreed to get the cars put into their name, register and insure it solely. Well my friend went as far as trading the one they had in and getting a new vehicle, hence taking it out of the other party’s name.
The problem is the other party has not done so yet. And to make matters worse they also lost their driving privileges/license, and are now driving without one and has even been seen drinking and driving. The next problem is the vehicle is registered and insured in my friends name and they don’t have a clue in what they can do legally to be remove from this and being liable for anything that happens in this vehicle. What can they do to be removed from this vehicle? And can they cancel the insurance and turn in the plates to DMV?

Your friend could always report the vehicle as stolen while he's driving it. That's a bit extreme though. But on the other hand, your friend could lose the vehicle all together as well as be sued if the guy has an accident while drunk driving. Which is the bigger risk?

I think the only way to be removed is to get the owner of the insurance to remove the name. Have they tried just going to the DMV to do this?
