Pro-life/choice opinions aside, what do you think? (Personally, I think if she doesn't want her daughter that much, she should give her up for adoption, and then all she would have to sue for is the cost of medical bills for the birth; maybe pain and suffering, but I want to hear other's opinions)

I guess I should re-phrase. The article says that she is suing for cost of child-rearing and I want to know if you think she should get that much compensation.

Morals and ethical beliefs aside, any doctor performing any type of surgery is liable of their mistakes during the proceedure. The lady might be able to sue for some sort of medical malpractice, depending on all the factors in the situation and case. If a doctor were to mess up a back surgery, they would be held liable, so the same should go for any surgergical proceedure, even abortions.

*EDIT*
In reference to being able to sue for child care costs... I don't understand why she doesn't give it up for adoption is she can't afford to care for it. Her first response was to abort because of financial reasons, and that was botched by malpractice (which she can sue for). So the next response would be to look at giving up the child for adoption. If she truely cannot care for the kid, giving it up is best. She isn't being forced to keep the baby, so suing for the cost of care seems rediculous.

I believe in fate! Obviously that baby was meant to be! That is a touchy subject though. If she did indeed pay for the procedure it should have been done correctly. I am sure however that she had to sign paperwork and I am sure in the fine print somewhere that was a clause of some sort stating that they are not always effective. My biggest question is what is this poor child going to think when she grows up and knows that mommy didn't want her and that mommy went public with this information! Poor Child! I would be too ashamed to sue them....She needs to think of the future!

That is so weird to me. I feel two ways about this. First she shouldn't sue because I know after holding her baby girl and looking into her eyes she wants her, how could she give her up?
And second she should sue because she did pay her money for the procedure to get done and if they didn't do what she paid for she should get her money back. And you are right, if she doens't want the child sue for the cost of medical expense and pain and suffering.
good question.

Never heard of a failed abortion. But I don't think that's going to go over in court. I would think she would know about it a the time this was done & if it didn't take they would try one more time.
So I say NO NO NO!!!!!!!!!
Why not go after the dad to make him pay for the baby he give to the world? For that matter why isn't the dad around to tell what his part in this child's life is going to be????

I think she's an ungrateful lady! I know that alot of women who have had abortions wish this could have happened to them. Then they would not have to live with the guilt that comes from killing your unborn child.Yes I do agree with you about the adoption. She most certainly does not deserve to keep this child if she feels she is a burden but only she knows if she truly loves & wants her.

Well if you think about it. She went there to get an abortion and they failed to do that. So, she should get something back for all the damages it has caused. But the thing that bothers me is that when the child grows up and reads this news.

you already know, my mom and pa grew up in the 50s, and their thoughts do no longer make it sound like this super golden age to me. specific, we've been given issues, yet from what they tell me maximum of this "Father knows superb" and "go away it to Beaver" stuff in user-friendly terms befell on television. Your eventualities do no longer sound precise to me. This kinda is going alongside with something i spotted a jointly as back. i'm gonna be 30 this 3 hundred and sixty 5 days. i'm commencing to hearken to human beings my own age ***** approximately little ones, their attitudes, the terrible stuff, the crime, and how none of this grew to become into genuine while they have been a baby. the difficulty is, I bear in concepts little ones being in basic terms as bratty, crime be as undesirable or worse, and the music being much extra risque now and back. And while i grew to become into in the army, my fellow Sergeants might moan approximately how standards have been slipping in effortless education, once you may delay education schedules from the two classes and see that it genuinely have been given longer and extra suitable. My factor? i think of as human beings become previous, they have a tendancy to idolize the previous, and assume that "now" is the worst time ever. They bear in concepts the sturdy, and forget lots of the undesirable. i'm going to guess there's a psychological term for this.

HELL NO, and if she does are world is so screwed up.. Its NOBODYS fault except her's. If she didnt want a baby she, should of used protection..."decided to have an abortion for financial reasons" she should of thought about that before she had sex, when you go to bed with someone you better already have it in your head that if I dont use protection I will probably get pg and if I do use protection I still have a chance what do I want to do here. Its time for people to be more responsiable with there lives instead of realying on abortion.

I don't believe in abortion, but I think that if you pay a doctor to give you one and it doesn't work then the doctor should be responsible for his or her mistakes and pay up.
