You can accidentally click on the flag, but after that unless you make a complete mess of it and miss understand the procedure, then no it is not really possible , if you check it out you will see there is a cancel button to press. So I think I`d say no, it isn`t possible to accidentally do it.

This is a question that is hard to answer specifically, so I can only give you a general answer.
For one thing, "violation" is really subjective, as well as categorized in several degrees of gravity.
You can violate a simple rule of talking on the cellphone while a meeting is going on..... or you can violate a human being by raping them, robbing them, attacking them.
Those are two extemes. The former, I wouldn't consider it a real violation, because I think the rule could be arbitrary (again, depending on what kind of a meeting is going on). The latter, most definitely, without a doubt.
As far as intent, it is more of a matter of how others take it, rather than what you do. If others were insulted by your inadvertent action or speech, but they don't say a thing to you and they start acting differently and distancing themselves from you without you knowing why, then I don't think you're guilty of the violation.
A lot of people out there tend to expect others to read their minds, and that's something that nobody can do with 100% certainty, and sometimes intuition alone won't do it.

No you have to click on the little flag thing and choose a category of violation, add a comment and click to send an e-mail. Not an unintentional act.

there are a series of steps you have to take in order to report a violation. it's not as simple as an accidental click.

Yes! We live in a world with vastly different cultures, religion and beliefs. What is acceptable behavior to one person can be discusting to another. For example: hugging and kissing- If you go to some places in europe- it is custome to greet someone- male or female with a kiss on both cheeks. But when I was in high school (forever a go)- someone was suspended for doing just that. THey labled it as "sexual harrassment". THe "offender" did not mean to anything that was out of line- that was just how he was raised. So yes! You definately can.
