first off i know what we did was stupid, so my friends and i were caught driving without a license, neither of us have a license and the one that was driving has only a permit but didnt have it with her at that time. so the car got towed and only my friend that was driving got a ticket. my question is that when she goes to court, am i going to get convicted too because i was a in the car(they didnt take my name down)? what will they do to my friend? help please.

no it wasnt my car, it was friends mother's car... we took it out.

what would you be guilty of as a passenger in the car? It wasnt your car was it?

You will not be in any trouble as you were the passenger in the car. As far as your friend goes...despite what the first guy said, not all these situations are solved by hiring an attorney and battling it out. A lot of time all that does in a traffic matter is piss off the judge and the officer. Your friend will likely have her driving record with the DMV suspended until she turns 18. Once she turns 18 she will be able to get a license like everyone else. As far as the current penalty...after all is said and done, it may cost her close to $1000. There is no custody time for driving without a driver's license.

The fact that the officer didn't take your name is a major clue that you aren't in trouble. If you show up for court and try to defend your friend as a witness, the judge may ask you some questions, but you shouldn't be in trouble.
Your friend can have several things happen in my state including delaying the age at which they can obtain a license. When you go racking up tickets without a license, you just are headed for trouble.

No, you are in no legal trouble. Your parents might kick you butt, but not the law.
Your friend will go to court and either enter a guilty plea or be found guilty. The judge has a lot of discretion in dealing with juvenile traffic offenders. He may suspend the fine and hand her a probation term (i.e., sin no more for six months). He may fine her a substantial amount of money or he can even jail her for some time. I suspect what will happen is a fine and probation. Of course, your friend's parents get to cough up the fine plus the towing charges for the car. Court may be the least of your friend's problems.

NO! You weren't driving the vehicle without a license or for that matter with a license! The charges are lodged against the "driver" not all occupants unless other circumstances exist like "drugs" or other crimes committed. Your safe this time and your friend will have repercussions to deal with! It's not a felony so you have one point in your favor. Now it's up to the DA and the judge who will make the ultimate final decisions regarding your friends punishment(s)!!! I find it puzzling the officer did not take your name and ask for identification to run a warrant check?? Incompentancy on his/her part! Apparently likes playing "Russian Roulette" with his/her life!

Nothing will happen to you. Your friend will have to pay her ticket and will probably get a graduated drivers license restriction added to her license (extending the period of time having to have someone over 18 in the car with her).

You sound too stupid to ever receive a drivers license.

Duh! You were only a passenger in the car, therefore you weren't charged with driving without a license and that's also why you weren't given a ticket.

Your friend's parents are going to have to hire a lawyer to help defend her. She is in a boatload of trouble.
