You need to slap him over the head and tell him that if he keeps this up that when he needs you to bail him out of something that you wont

The problem isn't your brother, it's your mom. Obviously, she doesn't trust you and has enlisted your brother's 'help' to keep tabs on you. If she hasn't, then her acceptance of this behavior gives the impression that yes, it's okay with her that he's acting like this, which will only make him continue the behavior.

You need to sit down with your mom and set some guidelines over what she feels is and is not acceptable behavior; it is her house, after all. Also, tell her how your brother's constant 'reports' are insulting and make you feel like she can't trust you--and if that's the case, why shouldn't you do the things she doesn't want you to do if she already thinks you're doing them? Hopefully, she'll see the reasoning there and the two of you can work it out.

Short of that, move out ASAP. You're old enough to make your own decisions, and you don't need a warden. Good luck.
