Depends what country you live in. For example, in Canada if you commit murder you get a death sentence, which is basically serving
about 25 years in jail before being eligible to apply for parole. In U.S.
it is much stricter, you commit murder and you might be put onto a death row.
Hope that helped you.

The death penalty is arbitrary. It does not focus on the worst of the worst, in any sense, but on defendents with the worst lawyers. When is the last time a wealthy person received a death sentence or was executed??

Whether someone faces the death penalty depends on geography- even within individual states- even within individual cities, depends on the race of the victim (a defendent is twice as likely to face the death penalty if the victim was white than if the victim was not white.)

Juries also add to the arbitrary nature of the death penalty - premature decision making, failure to understand jury instructions of the judge, misunderstating the death penalty alternative.

The rules are as varied as the mind sets of local prosecutors and local communities.

In most states the death penalty is only used in cases of extremely cruel or gruesome murders. The 1 exception is Texas where the death penalty is imposed for jay walking.

1. Being prosecuted in a death penalty state--it's a lot about geography.
2. Having an assigned lawyer.
3. Being poor and, therefore, not being able to hire adequate defense counsel.
4. Being a racial minority.
5. Being of the male gender.

In order for one to receive capital punishment, one would have to commit a capital crime. The only capital crime in my state is capital murder, wherein a murder is commited during the commision of another felony, such as rape, burglary, kidnapping, robbery, etc... Killing a law enforcemnet officer in their line of duty could also incur a capital murder charge.

It all depends on the state's laws.
