I am the victim of clear but not "simple" identity theft.
We have become aware of "identity theft" as "shown" on television commercials-someone takes our personal information and opens up a credit card - charges on that credit card - and NEVER PAYS!
What if someone opens up a credit card in your name and also PAYS THAT CARD!You say "that does not make sense"?? Well, think about this...the identity thief could be...A husband or wife is having an affair and wants to hide their where they go, etc.... or ....A person has filed bankruptcy and wants the convenience of having a credit card which they cannot have...or.... someone wishes to hide their spending from their spouse for other reasons. Is this not identity theft and is also a crime? Is it not time to portray this type of identity theft? It can go on for years without the victims knowledge!

What you describe IS simple identity theft. The fact they are not using you identity to steal from someone doesn't mean they haven't stolen your identity.

any time someone uses you're social security number or other personal identification information the crime of identity theft occurs, which is a federal code violation. the exception would be you're spouse as most states have "communal" property laws, when you get married you and you're spouse essentially become one person.
