Ok.. its a good question both for the image but also for a little bit of historic insight.
Here in California (where else - right). Your issue has already come to the court:
A driver for a funeral home was cited for driving in the carpool lane with 4 or 5 corpses in the 'pickup' van. He was cited and took it to court. His arguement, was that these cadavers constituted passengers and therefore he met the car pool requirement.
The judge, however, disagreed, citing that once a person dies, his cadaver is simply an inanimate object and no longer qualifies as a human or (obviously) a living being.
(a corpse is a corpse of course of course and no one can drive with a corpse of course unless of course ... etc etc.. sorry I could not resist a REALLY bad pun)...

Also in California, a woman was cited in the carpool lane and took it to court saying that she was 8 months pregnant and that the unborn fetus was therefore a passenger in her vehicle and should count.
Again, the court disagreed. Unborn is exactly that.. and while the right to lifer's would jump in there with a word or two, the judge pointed out that the potential commuter was really involuntary and it was not like he/she had a choice in the matter. This defeated the concept of the carpool. He did allow that, had the baby been BORN in the carpool lane or in the process of birth that in such a case the (new) person would indeed become a passenger and not simply 'carry-on'.

To answer the question while avoiding it completely, Yes you would be able to use the carpool because you can use the carpool with no one else in the car even though it is illegal to do so (man, I should be a politician)

Technically a ineffective individual isn't vehicle pooling with you because of the fact the act of carpooling is to commerce off shared rides.Or a minimum of it particularly is shared gas funds. actually, a mortitioner tried this and when pulled over told the cop that the 3 dead bodies in the back should count. he was given a tiket and went to court over it. the judge ruled against him saying that the people must be alive to count.
