the fee is on long distance servces that the companies had been charging and the governement said hey you cant do that.

Actually, it's the 2006 return, the one you file in 2007. You have a choice of deducting a flat amount, or totalling up the federal excise tax paid from March 2003 thru July 2006. If you take the flat amount, it's $30 for a one-person household, $40 for two, $50 for three, and $60 for four or more.

There's a line on each version of the 1040 form, in the payments section, to claim it. If you aren't filing a return, you can just file a form 1040EZ-T.

You can look at all you phone bills and calculate the actual amount you paid. Most people claim the 'standard' amount of $30 if you have 1 exemption, $40 for 2 exemptions, $50 for 3, or $60 for 4 or more. Use the same number of exemptions as on line 6d of the 1040.
