My 16 yr old daughter was in a car accident as a passenger. She had whiplash and sever headaches. Insurance is paying medical and her medical expenses stays open till shes 20 BUT they are only offering $750.00 pain and suffering? I feel this offer is way to low? Am I wrong?

I can't say. You didn't say how many visits she had to the dr and what kind of treatment she received. If she only went one time, yes 750 is very adequate. This is not the lottery. I don't say that to be mean, but a lot of people think whiplash is a big cash-in claim. It is not. Everyone wants to know what his/her claim is worth on yahoo questions but no one ever covers the important information to help price the case. Age, general health, amount of treatment, type of treatment, amount of medical bills (if they are part of the settlement which they may not be here) any pre-existing medical conditions and WHERE THE ACCIDENT HAPPENED are all things that are taken into consideration.

Be thankful they are paying for medical expenses until she is 20. Take the $750.00 and shut up about it. Figure it out, medical care at about $100 a pop (the minimum) every month until she is 20, approximately 3-4 years at $1200 per year that adds up to $3600 to $4800 even more than that for medical expenses. You would be benefiting over $5000 for medical expenses and pain and suffering. Look at the big picture.

There's nothing wrong with playing hard ball. I sprained my ankle once at a resort, total negelance in part of the resort. They offered me 500 bucks, i laughed and said i would be contacting my lawyer. They offered me 1500. I don't have a lawyer, but i'm sure there's pleanty of lawyers out there that would take the case, most would just take a % of what money you get. I would sue just because the insurance company insulted me.

well, you don't have to take their offer. if you feel your daughter deserves more, let them know. the ball is in your court. Offer them a counter offer. Unless she was seriously injured, I wouldn't bet on them paying more than and $1000 for pain and suffering
